First of all I have seen some horrendous dog injuries because of a owner doing this.
Yes I lived in California and had my dogs in the back of my truck three to be exact.. they had seats back there, harnesses that kept them in, goggles and socks for their feet and if it was really cold Jackets too on..
Yah they were a sight but I loved them and when I stopped they got unharnessed and the gear off and they were leashed up to the truck and there was a wood frame around my truck so they could not jump out and hang themselves but still enjoy the windy ride :)
So DON'T do it too many bad things can and will happen to your dog.
If you don't feel you can have him in the cab with you for whatever reasons then don't take the doggie.. simple!
No, it is not illegal however certain cities like Austin for example have ordinances that say it is illegal for the dog to be loose or untethered while in the bed of a pick up.

It is not recommended that anyone ride in the cargo area of any vehicle and in most states it is illegal. In places where there is no law against it, if anyone under 18 is riding in the back, the driver could easily be convicted of endangering a child.
