It all depends on what type of felony that person is convicted of. If the person must register in his state as a sex offender, the felony is of violent or drug nature, or the felony involves public assistance fraud, then by federal regulations the Housing Authority cannot accept this person into the voucher program. And the Housing Authority may have its own rules of whom they may exclude as convicted felons from their programs. Most often than not they include felonies of any kind of less than 5-7 years from the date of release from incarceration or supervision, whichever later occurred.

I think what you meant to ask is can a person with a felony get it and the answer is yes. depends on how much time since you got it, and whether it is a drug/violent felony charge. check with your local housing authority.

LET ME ADD TO THIS: As mentioned, each Housing Authority has the right to set its own rules regarding felony convictions and the Program. However, under federal regulations a person convicted of manufacturing meth, a registered sex offender, or someone convicted of fraud relating to the Program can never participate in the Program.

Whether the person is on probation or not, there are certain qualifications that must be met by everyone who is applying for the section 8 program. Persons with certain types of felonies: drug offenses, sex offenses, offenses involving public assistance fraud, and felonies of less than five years are likely to be disqualifiers for public housing or assistance vouchers.

The rules regarding felons living in a household under the section 8 program are the same whether the felon is a voucher holder or is living with one: he must be screened and approved by the housing authority before he is allowed to live in that household. The type of felony of which he is convicted dictates whether or not he will be approved.
