Aggravated assault is a crime, not a tort. Crimes are prosecuted by the state, and are not private law suits.

However, you can file a suit for the appropriate tort. Each state defines torts differently, but there is typically a tort for assault & battery that can be used to make a claim against a person that intentionally physically injured you.
