The answer to this question may depend on the state law in your particular state. It is doubtful, however, that you can just remove someone's name from the title for not paying his share of the mortgage; that would deprive him of any equity in the house.

In Texas, for example, you could sue to partition the property, have it sold, and divide the proceeds. If you have a contractual agreement with him to pay for part of the house, you could sue to enforce that contract.

Part of your answer would be dependent on how you acquired the property. Were you living together and bought the house? Did you buy it together as a business investment? Are you partners? Did you inherit the house? In each case, you have a different relationship with each other and possibly different obligations. In some cases, you might have a fiduciary relationship to each other that would require you to act in the other's best interest or be held liable.
