In Canada, a man was jailed for 5 years due to a false allegation of child sexual abuse made by his ex-wife. After being released, he sued and won $60,000 from her, which she has yet to pay, however he owes $75,000 in unpaid child support from the time period he was in jail. He has now been arrested for the arrears.

Judge David Grey Ross, Commissioner of the Federal Office of Child Support Enforcement felt it an unnecessary burden if upon release, a man whose trying to turn his life around, is saddled with a financial burden he may never be able to pay off.

"One of the ways is to recognize the fact that a person who is incarcerated has the right if they have an ongoing child support order, to move the court or move the administrative agency to reduce that order since they no longer have the ability to pay."

When a custodial parent dies is child support from a non custodial parent still due?

Of course. Unless the non-custodial parent takes sole custody, the non-custodial parent is still responsible for paying child support to whomever the child goes to. There is no reason the death of a parent should terminate the other parent's child support obligation.

In the state of Texas if you are seventeen and your parent is receiving child support does the child have to live at home for parent to continue child support?

Yes. Child support is for the "custodial parent". If you are not living at home with your custodial parent, then they are no longer eligible to receive child support. However, the non-custodial parent can request a modification if the child is no longer living with the custodial parent and that includes a change of custody. A 17 yr old is not emancipated in Texas, unless proper procedures through the courts have taken place. If that is the case, then the custodial parent and child are no longer eligible for child support.

What are reasons not to pay child support?

There are no valid reasons not to get child support. That money is supposed to be used to help raise the child. If the custodial parent tries to refuse child support before a judge, the judge will override the custodial parent's wishes and explain that the child support belongs to the child, not to the custodial parent.
