I think what you're saying is that there is no court order in place. If that is the case, then neither parent has legal custody, so who ever has the children then has custody. Not for final full custody. The court has to decide who the children will go to. If they have lived with stepparent for years and know him/her as a parent the stepparent have a chance for custody.
