The US Constitution allows only one Supreme Court, but grants Congress the power to create other federal courts as they deem necessary.

Contrary to popular belief, the US Constitution has nothing to do the creation of state courts. Each state has established at least one (sometimes two) court of final appeal (analogous to the US Supreme Court) within its judiciary. Each state court is independent of every other state court, and also independent of the federal courts. The state supreme courts are the highest authority on state law and state constitutional issues.

The US Supreme Court has no jurisdiction over state matters, except those statutes, policies, or amendments that conflict with the US Constitution, Federal Laws, or treaties. In cases of conflict, the US Supreme Court decisions, US Constitution, federal law, and terms of treaties with foreign powers supersede all state constitutions and laws, as explained in Article VI of the US Constitution.

The US Constitution is silent about most aspects of the Court's structure, including the number of justices required or permitted to serve at one time. Congress has authority to determine how many seats are needed to handle the Court's caseload, although this power has, at times, been misused to prevent a President from making nominations.

The size of the Court has ranged from five to ten justices as various points in history. Congress set the current number at nine in the Judiciary Act of 1869.
