If they do and are picked up even the slightest infringment, they will be tried and found guilty of "agrivated re-entry", that means they came back into the U.S. after they were deported for a felony and given specific instructions to not EVER come back. Once convicted for that crime they will be locked up for 1 to 10 years in Federal prison then deported again. In fact, they don't even need to be found guilty of another crime, they can just get the attention of INS/ICE and they're arrested.

If he was "deported" that term alone implies that he was legally denied access to the US. If he wants to visit he can try to obtain a US visa to enter the country, but it may not be granted.
You would need a waiver to excuse the deportation, which are difficult to get. Note that if you were deported for crimes, that some crimes will permanently bar you from entry into the U.S.

The victim could bring a suit against the alleged perpetrator in civil court but if the alleged rapist was not convicted the first time around, the case could not be heard again in criminal court, that would be double-jeapordy.
