An employer can ask about anything; when I ask some experts regarding this question a more "acceptably" answer seemed to be that personal problems were being attended to and now that things were better I was ready to go back to work. If you have had severe issues for two years maybe you need to look at the suggestions on disability .gov new site. It answers so many questions as well as having resources to answer more.
