First you should try to collect through the insurance for medical expenses. If you feel that you are not fully compensated, or you must miss substantial work from the accident, then a suit may be in order.

Do not deal with the insurance without an ATTY. Insurance companies are criminals. Basically insurance is supposed to be exactly that, "Insurance!" However, with our screwed up lawmakers getting special favors from insurance lobbyist, the laws are in favor of insurance companies rather than the injured.

I lost a significant amount of money by being injured and the insurance company is doing everything they can NOT TO PAY for my injuries and other costs, so I will be stuck in court with those morons, but my ATTY is seemingly good. When the insurance knows their client is At Fault they will round up all your prior medical records and try to prove that you already had the injury even if it's not true.

When you go to court the insurance company will never be mentioned and it will look like you are suing the other driver. In all actuality you are just trying to get compensated for what you are entitled to by the insurance company. The judge will instruct all parties not to mention the insurance company at trial so that it looks like you are suing the other little guy. The laws are so pathetic. It should be very clear upfront who is being sued. It's the insurance company not the driver as portrayed to the unwittingly jury.

If you try to settle on your own they will play all kinds of dirty games with you starting with the actual repair costs of your car.
