well you can always go through the bad way and that's court and have like 5 or more people have your back its going to be hard...and you are going to tell them why don't you want to live with that parent and why you don't like it
You are required to live with the parent that your custody decree awarded custody to. It doesn't matter what you want. If your dad has custody and you run away to live with your mom instead, it's even possible your mom could go to jail for this. If you think you can convince a court that it's in your best interest to modify the custody decree and award your mother custody instead, then you can always get a lawyer to petition the court to revise the custody decree.
The 18 year old is considered an adult. Nobody can have physical or legal custody of her.
If the court awarded custody of you to your Dad it will take action by the court to change your living arrangements. Your Mom would have to petition (ask) the court that gave you to your Dad, for your custody -or- your Dad would have to tell the same court that he was willing to turn your custody over to your Mom. If your Dad and your Mom are on speaking terms maybe they can come to some kind of agreement over this and they could both talk to the court to have the custody order changed. The thing is:(#1) Are you sure your Mom wants you to live with her in NY? And, (#2) there may be reasons (that you don't know about), WHY the court wants you to be with your Dad rather than your Mom.
In this day and age of child abuse complaints, it is recommended that the court assigning custody to the dad be notified and/or a police report be filed prior to the court notification of the runaway female. There, the dad will find out what the cause of the daughter leaving the confines of custody without serious implications to him will be revealed. Let the cops pick her up, not the dad.
They recently changed the laws of custody, No one parent has full custody UNLESS they see the other parent as unstable and unfit. If the parent you want to live with has been deemed unfit as a parent then it will have to be taken to court or you can contact certain child organizations to give you more details about how to leave your current home and return to the home of an "unfit parent" However if one parent obtained full custody of the child and the other parent was not deemed unfit as a parent, you may still live with them because of the recent change in custody laws, stating no one parent can have full or primary custody. (in other words, if your mom has full custody and your dad has none ((Also assuming the father hasn't been charged with being a drug addict, alcoholic, or financially unstable etc.)) you may live with the father)
you are 16 dad has custody you want to live with your mom Okay ^^^ I want to know can I go live with my mom I am 16 and my dad has custody
Yes, if his dad has custody of him. You might need to go to court again to get custody of your son, so he won't have to live with his dad. Good luck and God Bless:)
yes because no one have custody.
You could still live with your mom and your dad, but you need to leave when your 18 by yourself. But if you don't want to you could stay with your dad... if your mom lets you. That's what I think. Your mom can give consent and you don't have to go through a process, but yes you can emancipate at 15. Or wait it out until you're 18. if there's something serious going on just tell your father, too, and he can bring it up in court and get custody. What you're talking about is not emancipation. It's a change of custody. Dad would have to petition the court for custody.

If more than 30 days, and registered in school, than yes. If you want an alternate choice, see link
If he shows a clear pattern of improvement. see links
If you are a minor and you are living with your mom and you want to live with your dad you can ask your parents for a change of custody. If that is unsuccessful you can petition the court but will need to present a viable reason for wanting to switch.
It is natural to want to live with your mom in light of your dad's problems.
No, it's the parents who decide where you will live until you are 18yo.
There is no easy way. However, if you are a minor and serious about not wanting to live with your dad anymore then you need to think it through and come up with a list of reasons for your decision. Try to stick with the facts and don't be petty about your reasons. You should also consider whether it would be possible for your mom to have physical custody and whether she will agree to the change in custody. Choose a quiet time when you can sit down and discuss your reasons privately with your dad. If he has legal custody your parents will need to return to court to modify the custody order if your dad agrees to allowing you to live with mom.
Not until you have reached the age of maturity in your state. In most states that is 18. Your father can petition the court for custody though.
