If you are painting the mural for a client, (and being paid for it) you can not use copyrighted subjects.
If however, you are painting a mural on your own, or for example, your child's wall and there is no monetary exchange (or barter) involved, there is nothing that can stop you from doing the mural. Single one off usages without exchange of monies are not covered under copyright.
Generally the owner of the copyrighted material has to see/be aware of the infringement for there to be any consequences. That being said, if you are an artist, it is much better to follow the rules, as someday your work might be copyrighted and you would want others to behave ethically toward your "property."
