Weakness of Articles of Confederation
Drafted during the years 1776 and 1777, while the colonists were still fighting for independence, the Articles of Confederation created a weak national government with most of the governmental powers retained by the states. The Articles provided no separation of branches. There was no president or any other independent executive, nor was there a federal judicial branch. Congress, the legislature, was the only branch of government. Members elected to congress did not vote as individuals, but as states. While congress did have some powers, it could not enforce its laws on the states or the people. States were permitted to coin their own money. There was no regulation of commerce between the states and states could even enter into treaties with foreign nations and declare war, "with the consent of Congress." Congress could not tax the states or the people, it could only request funds to run the government.

Flaws of the Articles of Confederation: Denied a centralized national government; it denied it the power to tax or to regulate trade, not only between the United States and other nations, but also between the states. The Articles of Confederation were meant to put States' Rights over the rights of the National Government


The greatest flaw of the Articles of Confederation was that all the power belonged to the states. For example: the U.S. federal government had debts to repay but had no means of enforcing or raising taxes in the states. Furthermore the articles made it nearly impossible to amend the Articles themselves so no problems no matter how glaring could be fixed.

It was known for being weak, unable to impose taxes or do much that would really help to unite the colonies for a cause. Apart from its important Northwest Land Ordnance, it can be considered a failure that the constitution was created to correct.

There were several flaws in the Articles of Confederation. Mainly, it was drafted before independence was won. taxes could not be collected, and there was no executive figurehead.
