If you are filing a different type of writ, you will just apply by writing a motion.

Under US Constitutional law, a person that is arrested for committing a crime has protections guaranteed by US laws. To formally charge a person of a crime, a document called a writ of habeas corpus must be issued by a judge in order to formally hold a prisoner. This was borrowed from the English law adopted in 1669. The formal charge comes later in the form of an indictment. [usually pronounced in-DITE-ment]

The Writ of Habeas Corpus, or sometimes called "The Great Writ" has its first recorded history in a citation by Blackstone in 1305 during the reign of King Edward I. The Writ, known in its specific form as habeas corpus ad subjiceiiendum, requires that the prisoner be brought before the courts, or as in the case of Divine Right, before the king to determine whether or not that prisoners detention is lawful. As is with much common law it is unclear when exactly this principle first began to take effect but it appears it originated before the Magna Carta issued in 1215. The Writ was later codified into positive law by Parliament known as the Habeas Corpus Act of 1679.The history of the Great Writ, indeed, even the Magna Carta finds its roots in the early 13th century during the reign of King John, a considerably less popular king than his older brother King Richard the Lionheart. It was the rebellion of 1215 where the citizens of London literally opened their gates to the force of Barons who had had enough of King Johns ineptitude. These Barons forced King John to sign what is known as the "Articles of Barons" which insisted the king bow to the rule of law. This concept was also a common law practice known as destraint, but this was the first time that practice had been used on the king. The Articles of Barons was made into a formal document which was the first known copy of the Magna Carta, on July 15, 1215.King John, however, viewed this document as so restraining the authority of the king, that he would be king in name only, so he denounced the document as soon as the Barons left London which plunged England into civil war. Pope Innocente also denounced the act and annulled it, seeing it as an affront to the Church and that authority over the king, thereby releasing John to obey it. As the Pope said at the time:"It is a shameful and demeaning agreement forced upon the king by violence and fear."King John, however, died of dysentery in 1216, leaving his nine year old son Henry in line for the throne. The rebel barons had an easier time accepting the young king and the war came to an end on November 12, 1216, Henry's regents reissued the Magna Carta, this time excluding article 61, which bound the king to the rule of law. Henry's son, King Henry III, reissued the Magna Carta again on October 12, 1297 for the final time.The point of this little history lesson is to make clear that while the Habeas Corpus Act of 1679 entered into and codified as positive law the Great Writ, it was a law long before that, and it was, as is often the case, the spilled blood of warriors and rebels who fought for the rule of law that gave this Great Writ the force and weight it has today. It was Albert Venn Dicey, a British jurist and constitutional theorist who best described the weight of Habeas Corpus when he said:"The Habeas Corpus Acts declare no principle and define no rights, but they are for practical purposes worth a hundred constitutional articles guaranteeing individual liberty."
