It is the responsibility of the operator of the lease (British Petroleum) to shut in the well. They have tried and failed to actuate the blow out preventers. The related link has a link to the May 10 news conference in Houston which explains how BP is proceeding on two different plans at the same time (relief well drilling and a top kill) to stop the blow out.
