Yes. If someone performed work on your behalf when you were contemplating a purchase or refinance then you need to pay them for their time. No one can afford to work for free.

When you initiate a real estate transaction it sets in motion a process whereby various professionals must be contracted on your behalf to perform various tasks. Some of those people are self-employed and cannot perform any other work while they are performing yours. If warned ahead of time, "I need your professional services right now but I may decide not to pay you", they would not provide those services.

If your transaction does not continue through to its normal conclusion with a closing then you must pay anyone who performed work on your behalf. That may include the title examiner, surveyor, appraiser, etc. If you refuse to pay they can sue you in small claims court and if they win they can obtain a judgment lien from the court. The lien can be recorded in the land records and you cannot sell or refinance your home until the lien is paid.

Please consider this: no one would regularly volunteer to perform professional services if they were not guaranteed to be paid for their time.
