This is not correct. the State of California is ignoring Article 1 Section 9 & 10 of the U.S. Constitution as well as their own Constitution's prohibition against "Bill of Attainder (Bills of Pains & Penalties) in their collection of vehicle registration fees.
They address it thusly:
"The DMV records indicate that your registration is past due. as a result, DMV referred your account to the FTB (Franchise Tax Board) for collection and legal action is pending" (NOTE: The lack of any kind of offer of "Due Process")
"You must pay the full amount due or provide evidence that you are not required to pay. (NOTE: One must prove oneself INNOCENT rather than the state proving GUILT or liability) If you do not respond within 10 days of the date of this notice, we will pursue any of the following collection actions without further notice: (NOTE: Based solely upon assumptions. Factually, they don't know whether the vehicle still exists, where it is nor whether it has been operated in a manner to make fees become due)
Attach your bank account
Garnish your wages or other sources of income
Seize and sell your real or personal property
File a lien to attach all real property you now own or may later acquire in California.
Partial payment will not stop collection action; you must pay the full amount due. Since The Franchise Tax Board does not have specific information about your case, the amount due listed on this notice may not include all the amounts you owe.
If you disagree with the amount due shown on this notice or if you have any questions regarding specific account information please contact the DMV (916) 657-8120
