Three branches of U.S. government: the judiciary, the legislative and the executive, each with the powers outlined for them in their respective sections of the U.S. Constitution.
The attorney general's office, the director of the FBI, and the supreme court are some members belonging to both branches. This is because the Congress plays a role in naming and confirming these individuals. The two branches have a saying in deciding who to nominate.

It was not the FBI, it was Elliot Ness (et al) who worked for the US Treasury. The functions of federal firearms and alcohol (formerly prohibition) enforcement later transitioned to become todays Bureau of Alcohol, Tobacco, Firearms & Exploives (ATF) which moved from the Treasury to Department of Justice in 2004. Later at the end of his career Ness did work for the FBI, but not in the Capone time period.
The U.S. Secret Service is governed by the Department of Treasury, while the FBI is governed by the Department of Justice. The Department of Justice's head official is the Attorney General of the United States.

Since the FBI is a part of the Judicial branch and the US is run by checks and balances, it's either th Executive branch (the president) or the Legislative branch (Congress). My best guess would be Congress.
Politics are a very important piece of what the FBI does, somewhat like the CIA. For example if you have a leader who is publicly in favor or puts legislation for the legalization of weed, or cannabis he can order that the FBI decimalize drug offenses, or he can take certain staff members out of the organization that do not agree with the policy's views. All of this falls under the checks and balances theory, all the other political branches check on each other. For example if your an American you know what's happening with the NSA etc... those organizations like the FBI,CIA, and the NSA rely on the other branches. if a law is found unconstitutional by the Supreme Court under the judicial branch they can demand the law be removed, or congress under the Legislative branch can demand that the FBI don't execute operations against the laws.
Franklin Roosevelt was president when the FBI was officially started in 1935. Before that there a special agent force set up in the treasury department starting when Theodore Roosevelt was president in 1908.
