In an uncontrolled interscetion in a parking lot and you are travelling west and hit by a vechile heading south on the back passenger door, who's At Fault?
you enter the intersection first... that's the reason why you got hit because you knew the the intersection was not under control
The liability, or fault-factor in an accident has nothing to do with whether or not a driver was licensed. The liability in an accident at an uncontrolled intersection can be shared. Several factors go into a case like that & would need to be fully investigated to determine.
If it was an open intersection, the driver turning left is at fault. If there is a traffic signal, stop sign or one way street involved, it could be either driver, depending on circumstances.
you are at fault
Car B is at fault
If you were in the middle of the intersection it is your fault as you are not legally allowed to enter an intersection unless you have the time to safely complete the turn.
you. you hit him.
yoo are
The car who hit you is at fault , however if you did not have your brakes applied , and if having them applied would have prevented you from hitting the car ahead of you , you would be partly to blame for hitting the car ahead of you. That issue depends on the speed that the other car hit you and the distance you were from the car ahead of you
no, it is their fault for not letting you know they were stopping.
Depending on a city, but it doesn't mean you have right of way if there is one or multiple uncomming cars. Then it would be an illegal turn.
'I was in an accident last night, I stopped at the stop sign, saw another car coming down the road, belived they had a stop sign so I proceeded to cross the road and was hit (found out he did not have a stop sign) he was arrested for DUI and i was cited for entering an intersection.'
