Normally the car that hit the other car is going to be at fault. The vehicle behind you was obviously too close and was not following at a safe distance that would allow him to stop if you did. The police should have issued him a ticket.
The person at fault is the one that ran the red light or the amber light. Rules of the road are .... if you are already out in the intersection to make a turn on a green light and the light goes amber and then possibly turns red, you are inside the law, but, if you race out into the intersection on an amber light and it turns red and you get hit, it's your fault. EXAMPLE: A vehicle screamed out into the intersection on an amber light, then suddenly the light turned red and the oncoming traffic started up and hit that vehicle then it's the person who raced out into the intersection. Basically - according to the textbook: if you did not have a stop sign and the other car did - and the other car struck you - then the other car is at fault. HOWEVER - There are always WAY too many "ifs" to these questions. Was the view of the driveway obscured to the vision of the other driver? Is the distance REALLY as much as FIFTY feet? Did you come speeding out of the driveway and roar down the street in the space of a few seconds? If the police responded an investigated the collision THEY wouljd have had a much clearer picture of the chain of events. Although you may not like the outcome of the investigation, THAT is what the insurance company will probably base most of its decisions on.
techinically, the car backing up is at fault. as the car going in reverse, you are supposed to be aware of your surroundings, and the car behind you, has the right of way, whether the were still or moving doesn't matter.

I don't have an answer, just a question. When I was out driving in my vehicle, I came to a 4-way stop. I waited for my turn. The vehicle that had the right of way proceeded through the intersection. there was a cyclist behind the vehicle and it also proceeded through the intersection immediately after the vehicle. My question is shouldn't the cyclist waited until I went through the intersection since it was my turn? do cyclists not follow the same rules as vehicles if they are actually on the road and not in the bike lane? thanks
The outbreak of World War 2 was NOT Hitler's fault because he didnt sign the appeasement with chamberlain but all of the blame went on Hitler because her didnt sign this. He invaded poland but they wont happy so then the blame went on him again.
