It depends. If you are connected to a public sewer system and you have a sewer back up endorsement, then it shouldn't be an issue. If the insurance company wants to deny it they will call it a flood. A flood is considered to occur anytime water hits the ground before it causes damage to your house or property, and floods are always excluded. However, if there is a mechanical failure then yes it should be covered. When I was an agent we paid many claims resulting from sump pump failure but excluded coverage when it was evident the water came through the basement windows. We also turned down claims when the sump pump was operating to capacity but the amount of water overloaded it.

However, Should the sump failure result in a water loss and you have the appropriate coverage, the resulting damage would be covered once you have replaced the faulty pump.
