Marriage is a legal dependence. The oral vows are binding, and that's the purpose of the witnesses. You are legally married when the minister makes the pronouncement. Paper work problems among willing couples are simply worked out. If someone wanted out of a marriage which had paper work problems, the other party could sue for breach of contract and possibly require the other person to end the marriage through divorce. A serious misrepresentation of oneself could be grounds for the other party to seek an annulment.

There are a number of steps. First you get the license. Then the ceremony is done and the license is signed by the couple, the witnesses and the officiant. Then the license is returned to the courthouse and they will issue the marriage certificate.
