This law was put in place to put more children in jail for committing crimes and less in juvenile hall for running away and instead the kids are using it as a law to go live where they want. The same statute they are using to claim it is 17 also says it does not mean that the parent loses control or custody of the child and that you have to go to court to remove that right.

Because it is not a crime to run away at 17 the police can't take you to jail for it and juvenile jail won't take you because you are too old. The reason the police claim they can't do anything is due to worry over being sued in the event they take you to an adult jail at 17 and an adult in the jail hurts you. They could be sued for wreckless endangerment or neglect.

BUT they can put the person in jail who let the child live with them the same as they would a parent who steals a child from the custodial parent since under those laws the age of adult is 18. It doesn't matter if the child goes willingly or gives consent if the parents that have custody say no.
