It is possible to be sued even if you are disabled and on limited income. However, a plaintiff winning a lawsuit and collecting a judgment award are two entirely different issues. Generally people who have suffered great financial hardships are "judgment proof" when it pertains to lawsuits. Meaning that their income and property are exempt under the laws of their resident state. Income from SSD, SSI and other many other types of disability and pension benefits are not subject to creditor attachment. Likewise, most personal and real property belonging to a debtor can be protected from creditor action. Therefore it is possible for a creditor to sue, but if they believe the debtor to be execution proof, it is unlikely they will risk the added expense.

I am not a lawyer but of course they can sue you. But from what I've reasearched, if you're only source of income is Social Security Disablity Insurance, those checks can't be garnished. However, if it is for a student loan or government loan, they can be garneshed. Also I learned that if you were to file for bankruptcy and you had your social security money in a bank account (just say you got back pay in the amount of 10.000) that money is not protected. I read a case where a man filed for bankruptcy but the judge still ordered that he use his 10,000 to pay back creditors.

Another note. This is not factual but from what I've researched. Just say that you put all of your Social Security money into a bank account, say it was from back pay as well as your SSDI direct deposit. If that bank account was soley used for the deposits of Social Security money, if you are sued, the creditors can not touch it. If they do, you have to let the courts know so that they pay you back. You have to make sure to tell the courts and banks or they will take the money from you and it will be a hassle to get back. Another thing.....if you had a bank account that had your social security funds PLUS other funds like a birthday check, tax refund check, then you're account is open to the creditors.

A good idea would be to keep only your social security disablity funds in one account and in one account only.

So yes they can sue you, but if you're on SSDI and that's your only source of income, and you have all of your monies from SSDI in one account only, you're pretty much judgment proof. Check on this with a lawyer just to make sure
