Yes, if the officer has "probable cause". That means they see (from a point where they are legally positioned) something that indicates that a crime is taking place or has taken place. For example, if, as an officer walks past your property and observes you loading boxes labeled "Acme Birdseed" and has just heard that there was a burglary at the Acme Birdseed company, then a warrantless search could be upheld.

A search warrant was issued to your friend house and your truck was there can it be search?

No, because the warrant is for the house and house only. Although police officers would probably still search the vehicle, only to use the warrant as an excuse for an illegal contraband hunt.

What are the two exceptions to the fourth amendment ban on search and seizures?

1. Probable cause, meaning if an officer can immediately see, touch, taste, hear, or smell, witness to an illegal or suspicious activity or object he can just walk in and arrest you, regardless of where you are within the respective jurisdiction of city police, state police, or federal law enforcement. When law enforcement doesn't have jurisdiction or solid evidence they can get a search warrant from a judge, and they are limited to discovering something only in rooms or properties specified, and being of the nature of what they think you have. If an officer can't witness the illegal activity taking place, they can convince a judge that they have probable cause by evidence, or observations/circumstances that are of a nature that could persuade a judge to issue a warrant. However, if an officer were to arrest you without solid evidence to any crime the case will be thrown out at the presiding judge's discretion. Even if a warrant let an officer onto the property to search a shed, and incriminating evidence was found inside the house, without the officer being invited in, the case would be thrown out for violation of the 4th. 2. The second is the US Patriot Act.

When is a search illegal?

When they don't have a warrant for whatever they search ( even if they do have a warrant, it is usually for one piece of property house, shed, etc.)

What is a fleeting-target exception?

An exception to the exclusionary rule that permits law enforcement officers to search a motor vehicle based on probable cause but without a warrant. The fleeting-targets exception is predicated on the fact that vehicles can quickly leave the jurisdiction of a law enforcement agency

Can an officer inspect the outside of a vehicle without a warrant?

The idea behind a 'search warrant' is that you have a reasonable expectation of privacy, and the warrant gives the police a legal right to invade that privacy. So if they want to search you, your property, or your vehicle, they need that warrant. However, the outside of your vehicle does not have that expectation of privacy. An officer does not need a warrant to inspect your car's outside more closely, whether it is to check the condition of the tyres, the presence of paint scrapings, or perhaps to narrow down the location of a suspicious odour. On a side note, in some places an officer can 'search' inside a vehicle without a warrant, ie, if he saw a bag of cannabis on a car seat, through the window, he could use that as probable cause to get a formal search warrant to retrieve it. Things left out in the open like this inside a vehicle have a lowered expectation of privacy.

Can the police search the premises without first showing a search warrant?

Yes, the officer may search. Police may search a building if they reasonably believe a valid search warrant has been issued. They do not have to possess the search warrant.

What is a court order allowing an individual or his or her property to be searched or siezed is called?

When police officers have a court order to search a home or a person, it is called a search warrant. If a police officer has reasonable suspicions, then they can search a person without a search warrant.

What does one refer to when speaking about a search warrant?

A search warrant is a legal document issued by a court that authorizes law enforcement officers to conduct a search of a specific location, such as a person's home, vehicle, or office. It allows the officers to collect evidence related to a suspected crime. The warrant outlines the scope of the search, the items to be seized, and the authority for the search.

When a police officer serves a warrant does he bring it with him?

In most cases an officer who is serving a Search Warrantwill have it in his possession. However in special cases such as a warrant obtained over the radio or telephone the search warrant may not be immediately available. Arrest Warrants are most often 'unplanned.' An officer stops a person or a vehicle and is told over the radio that an there is an arrest warrant for a person. Since a warrant is a command from a court to arrest a person, the officer will arrest with only the work of the poilce dispatcher.

Does a police officer need a warrant to go through your car?

Police may not need a warrant to search a vehicle according to the mobile conveyance doctrine. A vehicle must be in a public place, readily mobile, and the Officer must have probable cause to believe contraband or evidence of a crime is contained with in the vehicle. If all of the above is met, the Officer will not need a warrant to search the vehicle.
