Yes in the US, but usually there can be an alternate job away from patients that they could do during the flu season, and many employers will try to reassign if at all possible. It can vary widely state to state, usually with some qualifying perimeters, such as whether the job puts them in care of the infirm or hospitalized patients, whether they have Allergies or have other medical reasons that prevent them from safely being vaccinated, etc. Those who reside in retirement homes are typically very vulnerable to the flu and some estimates are that seniors and institutionalized patients comprise the majority of those who have complications and death from the flu (approximately 36,000 per year in the US alone).

In a right to work state can an employer terminate an employee if the reason given is illegal?

If you live in a right to work state, then you have the right to chose whether or not you join a union and pay dues. You cannot be fired for refusing to join a union. It does not mean that you can't be fired. However, if you feel that your termination was illegal, then you should consult an employment attorney.

What if an employer refuses to pay reimbursable expenses?

If your employer agreed to reimburse you for legitimate expenses and is refusing to, one option would be to threaten to file a civil lawsuit against them to force them to pay. However, the negative aspect to doing so is that the employer may terminate your employment unless you have a employment contract.

Can an employer send someone home for refusing to sign writeup?

Sure. Signing a disciplinary letter does not mean you agree with it, it just means you've seen it. Refusing to do so is insubordination. The employer can send you home, or even fire you for it. All you're doing by refusing is writing "I'm a pain in the ass" across your own forehead.

Can your employer fire you for shop lifting at another store?

short answer: No. But you may be fired for other reasons (listed below). And your employer may keep a closer eye on you to find such reasons. But if they fire you BECAUSE you shoplifted at a different store, then you go to Employee Standards and file a complaint. Quote- "There are a number of circumstances where an employer is not required to give notice of termination. Probably the most important of these circumstances is termination for "just cause." Examples of just cause include:willful misconduct, disobedience, ordeliberate neglect of duty, where these actions are not condoned by the employer. Other circumstances that permit an employer to terminate employment without giving notice include:the employee was hired for a definite term or task of less than 12 months, at the end of which the employment terminates (the 12-month limit for term or task does not apply to oil well drilling or geophysical exploration),the employee was laid off after refusing an offer by the employer of reasonable alternative work, the employee refuses work made available through a seniority system, the employee is not provided with work because a strike or lockout is taking place at the employee's place of employment, the employee is employed under an agreement by which the employee may elect either to work or not to work for a temporary period when requested by the employer, the contract of employment is or has become impossible for the employer to perform by reason of unforeseeable or unpreventable causes beyond the control of the employer, the employee was hired on a seasonal basis and at the end of the season the employment is terminated, the employee is on temporary layoff and does not return to work within seven days after being requested to do so, in writing, by the employer, the employee is in the construction industry, the employee is employed in the cutting, removal, burning or other disposal of trees and/or brush for the primary purpose of clearing land. When an employee's employment is terminated for 'just cause', the employer must pay all wages, overtime, general holiday pay and vacation pay due the employee within ten days following the date of termination. The employer must be able to support their position that there was just cause for dismissal without notice." quote- "The length of notice an employer is required to give depends on the duration of employment and must be in writing. The minimum notice requirements that employers must give are:one week - for employment of more than three months, but less than two yearstwo weeks - for employment of two years, but less than four years, four weeks - for employment of four years, but less than six years, five weeks - for employment of six years, but less than eight years, six weeks - for employment of eight years, but less than 10 years, andeight weeks - for employment of 10 years or more. An employer may choose to give pay for the required notice period instead of providing notice. A combination of written notice and pay in lieu of notice (termination pay) is also acceptable."

How can Dollar tree demote a asst. manager while on sick leave with a doctors note. And not pay the sick leave as well?

Demoting an employee while on sick leave, even with a doctor's note, can generally be seen as unfair or potentially in violation of labor laws. Furthermore, refusing to pay sick leave would also likely be inconsistent with employment regulations. It is recommended that the individual consults with an employment lawyer or labor department to understand their rights and explore appropriate recourse to address the situation.

Can an employee be dismissed for refusing to allow an employer to view his medical records?

Very little of the health record privacy law (HIPAA) applies to employers, but this is in there: employers cannot compel you to reveal medical RECORDS except those needed to claim a medical-based benefit like FMLA, workers comp, or ADA accommodation. The employer can compel you on pain of discharge to demand necessary records from your doctor, who cannpot refuse YOU. The employer cannot demand records from your doctor, but can hire a doctor to demand the records and review them.

Can a company drug test and employee that suffered an injury?

Possibly. When an employee fails to comply with pre-agreed terms (having the drug testing), it may be possible for them to deny payment for treatment. I think the bigger question is why you are refusing to have it done. The hospital/doctor ect. can not refuse to give you treatment for a work related injury or any other injury for that matter..However your employer can refuse to pay for your treatment if you refuse a drug screen and then you will be responsible for the cost on your own. They can also immediately terminate your employment for refusal to submit for a drug screen. By refusing a drug screen for a work related injury you can lose all claims for any workers compensation..However If you test positive for the use of drugs or alcohol your employer can also terminate you and refuse to pay for your treatment. If you test positive for drugs or alcohol you may also lose all claims to workers compensation.being that you were under the influence and the accident was a direct result of your deliberate and willful impairment. So either taking or refusing the drug screen can have the same end results if you were using drugs/alcohol at the time of the accident..

Is refusing an adverb?

No, the word "refusing" is not an adverb. The word "refusing" is actually a verb.
