I live in Maine. I went throught a divorce in 05. My children were 11 and 13 years old. They got to choose which parent they wanted to live with. They chose the one who had less rules, no discipline, no structure and didn't work.

What is the age for children deciding which parent to live with in Florida?

The child cannot make that choice. A parent needs to file a challenge, during which a GAL will present the child's view to the judge. Or, arrangement for the child to speak to the judge in private. The judge determines the child maturity, and related factor, in a custody change. see links

Can a 12-year-old choose which parent they want to live with?

No, but he or she can speak with the judge and explain why he or she wishes to reside with a specific parent. Custodial issues are determined by what the judge feels is in the best interest of the child and not on the preference of any of the interested parties.

Can a child at sixteen go to court to speak of which parent they want to live with?

Depends which state you are in. The judge usually ask a child that age of his wish even though it is not in the law like in some states, but the judge is not obligated to follow it.

Can nc kids at age 12 decide who to live with?

Not arbitrarily. The age of majority for the state of North Carolina is 18. That being so, a minor is not allowed to choose which parent he or she wants to live with. In most custodial cases a child who is deemed able to understand the matter at hand will be interviewed by the judge who has jurisdiction in the custodial case. It is at the descretion of the judge whether or not to speak with the minor child/children. The judge also will decide whether or not the knowledge garnered by the interview will be used in deciding which parent should retain physical custody of the minor child.

Can a child speak with a judge during a custody battle?

Yes, however it could be viewed as a sign of Parental Alienation Syndrome. which the child may not realize they have as a primary parent can be very good as manipulating how they think about the other parent.

How old do you have to be to choose who has custody over you?

There is not an age at which a minor is allowed to choose where or with whom they wish to live. A judge may speak with an older teen concerning the issue, but the decision will be based upon the what the judge feels is best suited for the optimate well-being of the child or children involved.

Is it legal for me to ask a judge for me and my younger sibling to stay together throughout divorce?

Sometimes the judge may speak with the children in a divorce case to see how they feel about it. You could ask the judge before the case goes to court if you could talk with him/her.

Can children request to be heard in family court regarding visitation?

Absolutely! The judge is very interested in the welfare of any child, but, in some cases, although you may not understand the outcome of the courts decisions at the time, they do have your best interests at heart. You can always ask the lawyer in the case that you would "like to speak to the judge in chambers." This means that you can talk to the judge and express which parent you prefer to live with or which one you prefer not to visit. Good luck Marcy

Can I live with my father?

Minors are not allowed to choose with whom they wish to live. That is a decision made by the court if the parents cannot reach an equitable solution as to who shall retain primary custody of the child/children. A judge may speak with a child who is mature enough to understand the matter and consider the child's personal interest, such as schooling, friends, etc., issues that will not be discussed with the minor child are which parent the child cares for more, disciplinary tactics of either parent, and so forth. The final decision of custody is based on what the judge believes to be in the best interest of the child/children and not on the preferences of any of the involved parties.
