Yes.â™
It makes no difference whose name appears on the loan, the vehicle can only be registered in the name of the person named on the title.
The car goes back regardless. If BOTH of the two people are on the loan, then BOTH are responsible. But if only one is on the loan then ONLY that person is reponsible.
In order to refinance even in one persons name, anyone else who is on title must be present at closing. You can't legally refinance a home unless all people on title are present at closing. In any case names on a loan do not directly reflect names on title, you can have one person on a loan and 5 people on title.
The short answer is yes, if you want to keep the car. Otherwise the loan will go into default and it will be repossessed. If you did not sign for the loan, it will not affect your credit.
If there are 2 people on the deed of trust and only one on the loan - then the person who has defaulted on the loan will have their credit negatively affected. The one who is only on the deed of trust will lose ownership to the bank or mortgage company, however, their credit will not be affected unless they co-signed or guaranteed the original loan that has defaulted.
No you can't. As the term implies, a title loan is given using the title to a particular piece of property as security (be this a car, boat, house etc). As such, the loan can only be granted to the person whose name appears on the title. I found this site to be a good resource for questions on title loans - http://titleloansfaq.org (just copy and paste the url into your browser) Hope that answers your question :)
The only way to get your car title back from the Bank of America is to pay of the loan that the title is collateral for. If the loan is paid off, they will send you the title in the mail.
They can only repossess the vehicle which was on the loan agreement. Taking any other vehicle is theft.
Yes, the loan can be in one sole persons name, but the title can remain in two peoples names or be transfered into one. If you need some help with this I handle situations like this all the time give me a call 214)607-1445.
The title has nothing to do with the loan. The loan will need to be refinanced using a different cosigner or only the primary borrowers.
If the title says "and" then both people are needed to sell the car. If the title says "or" then only one of the people is needed for a sale.
Only the lender can take a party off a loan. Generally, a loan must be paid off and refinanced to convert it to one person's name. If both parties are on the certificate of title, one party must voluntarily give up their title to the car by signing the title over to the other party.
