Absolutely, in fact, most repossessions are illegal per the 5th and 14th Amendment of the Constitution of the United States. To take away someone's legal property, you must first bring them to court if they are a party in interest. Repossessions and unlawful retainers were originally designed for renters and tenants who have zero property rights, but now applies to everyone because of the corrupt system we live in.

According to the 5th Amendment, you may not be deprived of life, liberty or property without due process of law. That means if a tow truck driver comes to your house to pick up a car against the owner's will as a party in interest to the vehicle, you may be charged with Civil Rights violations in addition to Grand Theft Auto.

If the bank does not take the person

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
