While this question may be intended as a joke, it is sad to note that in the 1700s and 1800s, some people did get arrested because of their disability. Back then, there was fear of mentally retarded people, and a total lack of understanding about what causes this condition; undoubtedly, some mentally retarded or mentally ill people were arrested simply because they looked and acted so different.

Today, it is rare for a mentally retarded person to be arrested as a result of prejudice. People in law enforcement are more familiar with the symptoms and behaviors one might see in a person who is developmentally delayed in some way. And if a person with retardation is arrested today, it is for suspicion of breaking the law, rather than because of a fear of that person's disability.
