If you have had it scanned for a microchip and there is no evidence of ownership then you may be able to adopt it. I would consult a local animal shelter behorehand.

What you've pointed out is definitely a homeless cat. The best thing to do would be to call a no-kill shelter and try to get them to capture the cat. If you think you can do it yourself, capture the cat in a cat crate (or something similarly sturdy) and take her to a no-kill shelter yourself.
