You can, but don't expect to get much more speed out of such a tiny motor. They were just designed for riding around cities, not for road worthy speeds. How ever, if you really want more speed, you could upgrade to heavier roller weights in the transmission, upgrade the air intake and exhaust along with re-jetting the carburetor, upgrading your CDI/Rev limiter, upgrading to a larger millimeter carburetor, or getting a big bore kit. While these upgrades may give you better acceleration and a little more top end, they will cost your reliability, fuel economy and overall engine life span.
The best way to get more speed is to buy a bigger moped or scooter. Remember, there is no replacement for displacement. A bigger engine will put out way more power and be geared higher. If you get a 150 cc moped you will be able to go 60-65 mph and have solid acceleration and hill climbing power. Sure, you can make a 50 cc scoter go 55 mph, but that will KILL the engine. The moped and engine were not designed to go any where near those speeds. So if you really want more speed and to keep your reliability, go with a bigger moped.

It depends on how many "cc" it has. If the moped if under 50cc than yes it's legal, but if the moped is over 50cc than no, is's illegal.
