Here's the situation...
I put a deposit down on the car (internet buy), a few weeks later I came in w/ a certified check to purchase the car. I did not test drive the car, but sat in it, turned it on and it had a faint smell of smoke in the car, but the salesman said he as far as he knew, the car hadn't been smoked in. I gave him the benefit of the doubt and since it was a VW certified car, I went in and singed the contract and took delivery of the car. I drove it off the lot, waited for the car to warm up, turned on the heater and sure enough it was blatantly smoked in... I talked to the sales manager and of course he wouldn't take it back, but i left the keys and car there, and put a stop payment on the check.
The car was off the lot for no more than 20 minutes, and I must have put 15 miles on the car...
This said, is there a way for me to back out of this?
The VW Certified inspection says the following...
#14 "in first class condition"
#73 Upholstery - Free of odor
#99 Heater operation is normal
But they have a signed contract in their hands. Mind you this was done Friday night, so the car hasn't been registered, etc...
