DURHAM -- Local landlord James "Fireball" White's real estate company is in bankruptcy and is trying to get a federal judge's permission to sell assets to pay off its debts.

So far, U.S. Bankruptcy Court Judge Thomas Waldrep Jr. has given Haskell Properties the green light only to sell one vacant lot. The company and its lawyers on Sept. 30 filed paperwork seeking permission to sell three more.

Haskell Properties' holdings include three tracts at the corner of North Mangum and West Corporation streets that officials with the UDI Community Development Corp. want for a redevelopment project.

As of Monday, Haskell and its lawyers hadn't sought permission to sell those parcels to UDI.

Waldrep held hearings on the first sale request almost three months after the company first asked for it. Hearings on the other three tracts are scheduled for Nov. 4.

UDI is also trying to buy a city-owned parcel next door to White's holdings. City officials are considering the nonprofit's request, to the consternation of neighbors dubious of the nonprofit's plan.

Haskell Properties filed for bankruptcy in April and faces $647,000 in debts, according to court filings.

Its largest single creditor is former Wake Forest University and National Basketball Association star Rodney Rogers, who is White's former son-in-law. Rogers loaned the company $500,000 in the mid-1990s and as of mid-August hadn't been repaid.

The company also owes $63,441 to the Internal Revenue Service and $57,320 to the city government.

The IRS debt is for unpaid taxes. John Peterson, a financial analyst brought in by the court-appointed bankruptcy administrator, said in May that Haskell Properties didn't file federal tax returns for about 10 years. The last known return dates from 1998.

The city debt is Durham's bill for demolishing run-down buildings that once stood on eight Haskell Properties-owned tracts.

White himself isn't managing Haskell Properties' affairs. Peterson said the landlord "has been diagnosed with dementia." Tisa White Rogers is managing the company in his place. She is White's daughter and the ex-wife of Rodney Rogers.

The company's books as of May were "in disarray," to the point it had to create new ones, Peterson said.

Haskell controls 36 properties in Durham. Of those, 12 are vacant and only two are producing any income. Peterson said the other buildings in the company's portfolio "need repairs" before they'd be suitable for tenants.

The two income-producing tracts generate $2,050 a month.

Haskell's bankruptcy is a Chapter 11 filing, meaning the company can reorganize rather than go straight to liquidation.

Peterson in May voiced skepticism about the chances of a reorganization, saying the odds there were "less clear" because of the back taxes, the problems with the books and White's medical condition.

But the company's plan now is to "sell off as many parcels of its real estate as are necessary" to pay off negotiated settlements with its creditors, Haskell Properties lawyer James Talcott said late last month.

The company's assets are worth about $1.9 million, so it has "substantial equity," Talcott said.

Other court filings indicate that Haskell has permission to hire a real estate broker to handle sales, and that Tisa Rogers can loan the company $80,000 of her own money.

The four land sales Haskell Properties has sought the judge's permission to execute all are second-chance efforts that fell through pre-bankruptcy because a creditor wouldn't release the tracts from "a blanket deed of trust" pledging them as collateral.

Court filings didn't name that creditor, but Rodney Rogers holds a deed of trust on almost all of the company's holdings, including those four tracts and the three involved in UDI's project.

Rogers in September agreed to the only sale Judge Waldrep has approved to date, of 2717 Edmund St. to GAR Inc., a local real estate company.

At the time, the former NBA star reserved the right "to take different or contrary positions" about other sales, his lawyer, Amos Priester, told the judge.

Officials in the city's Office of Economic and Workforce Development couldn't be reached for comment on Monday. Nor could Ed Stewart, UDI's chief executive officer.
