It was not the (expected) ruling against Scott's freedom that caused the controversy. It was the reason given - that they claimed slavery was protected by the Constitution. If taken literally, this would invalidate all of the compromises between North and South, and make slavery legal in any state of the Union.

If Scott had applied for his freedom while on free soil, it would have been granted automatically, but for some reason he didn't. He applied when he was back in slave coutnry. The local judges had never dealt with this situation before, and that is why the case reached the Supreme Court.

Scott lost the case, but he and his family were purchased by Taylor Blow, son of a previous owner, Peter Blow, and emancipated on May 29, 1857. Scott got a job in a St. Louis, Missouri, hotel, but died of tuberculosis less than 18 months after being freed.
