In general, mobile service providers don't care what phone you use. They'll give you one free (or at a reduced cost) if you sign up for a two year contract, but they could care less whether you use it or not... you could buy some other phone (probably for full price) and use that instead, as long as it's compatible with their service.

If you're asking if you can get out of the two year contract - technically yes. You'll have to pay an early termination fee, which is often steep enough that it makes more sense to stick with a plan even if you don't use it for the remainder of the contract.

Some providers might be willing to provide you with a new phone after a year, if you go in and ask, provided that you sign an extension of your contract. In this case the early termination fee is typically waived.
