Well, if I'm not mistaken, it's not an affirmed "no".
I think in Massachusetts they require a permit that requires you to have 2 years experience with the animal, and have that "experience" affirmed and written down in some proof form, then you need to represent that to fish&game department, and see if they will grant you the permit.
It's honestly I really long process, even if you're completely qualified, and it's difficult to do, but you CAN get one, and then it should be legal in your state - but know that you'll need to check you town/city laws too, because some completely ban them...

In Michigan, only NATIVE animals need DNR permits. This includes Red Foxes that are red in fur color (You do not need a DNR permit for a Red Fox that is Marble, Cross, Silver or ANY other color phase than red. Silvers, Marbles and Crosses ARE "Red" foxes though, just like how there are Yellow, Chocolate and Black Labradors, they are all Labradors) and you would need a permit for a Grey Fox. Fennecs are not native to Michigan.

It's all dependent on the type of fox. Under Type II of the TN Exotic Animal Laws, you may not legally own a native species. This would include Red Foxes and Grey Foxes. They are outright illegal to own. Arctic and Fennec foxes on the other hand are not native to Tennessee and therefore are legal to own without permit.
