I have asked Verizon this question and the same answer every time, if the phone is labeled smart the plan must contain the smart data. only way to avoid this is to research your phone choices well, and find what should be the closest to but not yet counted as smart phone.

Ya my friend has one and she never had to get the data plan. With any AT&T smart phone, you have to get the data plan. With Verizon, you can choose on most phones. Either way, chocolate touch isn't a smart phone anyway.
