Even if your state provides an exemption from this, isn't he one of the people you want to protect more than anyone? Doesn't he expect you to take care of him as an employer? Workers' Comp pays lifetime medical for work-related injuries, and can retrain a worker who can't perform his old job any more due to a work-related injury. Even if you provide or he has health insurance, who will pay those premiums if he can't work? Please carry Comp.

Contact your state - but if you're exempt from having to have insurance that doesn't mean you should forgo coverage. Even if you have health insurance, who will pay for that if you're seriously injured & can't work? Comp offers lifetime medical benefits due to a work related injury. Maybe you sometimes use subcontractors too, and your state may be one that says you have to provide coverage for your subs who don't have it - talk with your insurance agent first, and if you opt to take the exemption, do so legally. Also, some of your clients may require you to carry this coverage even if the state says you're exempt - you may be able to get higher pay from the General Contractor because you provide your own insurance.

According to Entrepreneur Magazine's "Ultimate Guide to Worker's Compensation Insurance," Maryland requires Comp for all employers with 1 or more employees.

If you are paid a wage or a salary for temporary work, the employer must deduct ALL taxes, social security and workers comp. If you are a subcontractor paid on a 1099, (which means YOU will pay all the taxes, etc) then no deductions are taken from your compensation. So it depends on the agreement you have with the contractor. He cannot, however, just take out workers comp and nothing else.
