Does the 3 day right of rescission rule apply to home loans in Michigan?

The three-day right of rescission rule applies to all loans covered under the federal Truth in Lending Act. This is a federal law that applies to loans in all 50 states that fall under the guidelines set in the act. The majority of types of typical loans that homeowners take out on residential properties will be covered by the TILA, and have a three-day right or rescission, including loans in Michigan.

Can cosigner change his mind after signing the contract?

No. Once you have signed you are responsible for making sure the loan is paid. (An exception would be contracts signed at your home which have a right of rescission built in.)

Where can someone get information on mortgages for home purchases?

What is a Notice of rescission of acceleration of loan maturity?

A "Notice of Rescission" is the right of an individual involved within a contract to return to the identical state as before they entered into the agreement, due to courts not recognizing the contract as legally binding. Therefor, a "Notice of Rescission of Acceleration" would be a case where the interested party (presumably a mortgage company or lender) has ceased pursuing another entity or individual regarding payment acceleration for reasons which could be complicated in a court or in an effort to avoid going to court. An example, a lender provides a home owner with a mortgage and the homeowner, after a few years, can no longer pay the full amount on a monthly basis. The mortgage company pursues acceleration of the loan while the homeowner pursues getting the mortgage restructured. Restructuring gets finalized before the foreclosure is complete, so it becomes in the best interest of the mortgage company to rescind the matter of foreclosure through a "Rescission of Acceleration" and allow the homeowner to continue payment on the mortgage at the reduced interest rate.

Is there a right of rescission on car purchases in MN?

No. The only time there would be a consumers' right of rescission is if the dealership contacted you at your home, brought the car to your home and signed the paperwork in your home. If you traveled to the dealership under your own free will, there is no right of rescission on the purchase of an automobile in the State of Minnesota.

Is there a rescission period for a real estate contract in Ohio?

Generally, no. Every contract doesn't carry with it a right of rescission. They are more geared toward high pressure sales and especially sales contracts signed in your home from a seller who approached you where you live. Does Tennessee have a right of rescission for auto purchases?

No it does not. The Three(day) right of rescission is only for in home purchases .(these laws were designed to help the elderly from pushy salesman). Sorry Tennessee or most states does not allow you to drive off and then return 3 days later but most Dealerships dont want unhappy customers...so what do you do? Simple, go in and talk NICE to the Dealership(leave the legal eagle attitude at home...give them a reason TO help you) explain your problems, concerns unhappiness and tell them how you will speak highly of their ethics and customer service and even offer to write a letter stating how please you are with them....better try sugar instead of vinegar...promise!

Does the 3 day right of rescission rule apply to auto purchases in Oregon?

http://www.doj.state.or.us/finfraud/coolingoffrule.shtmlTypically, the only time you will get a three day right of rescission is for a home solicitation, also known as a "door to door sale." There are a few other times you may be able to rescind an agreement within three days, such as with a home mortgage, but usually, if you buy something, it is yours. There is no "cooling off period" for the purchase of a motor vehicle. There is no "cooling off period" for the purchase of a good, just because it is really expensive or you decide you made a mistake in buying it. There is no "cooling off period" if you buy something from a telemarketer.

How many days do i have to take a car back to dealer in New York state if you do want the car?

Unless the sales contract states you a Right of Rescission, once the contract is signed by you and the dealer, it is binding. A right of rescission in a contract gives you a cooling-off period where you can walk away from the deal. It's normal for homeowners to have this right when they use home equity loans to tap the equity in their homes, but isn't standard fare on the purchase agreement for a automobile.

Is there 3 day right of rescission law in Minnesota regarding used cars?

Unfortunately, no. There is a 3 day rescission period for home loans but apparently not for cars (which doesn't seem to make sense as it is the second biggest ticket item most people are likely to buy). That law only applies to unsolicited sales. A automobile is a solicited sale as you go to buy the car the dealer does not come to you.

Can you return a car with in 3 day in minnesota?

Unfortunately, no. There is a 3-day rescission period for getting a home loan but not for buying a car.

Does the 3 day right of rescission rule apply to lot loans?

"You should have three days (not including Saturday, Sunday or a bank holiday) to rescind your loan. Call the title company and find out if it must be in writing. Usually there is a document in the pack of papers they give you that states the dates involved and how to do this." *Correction:* The 3 day right of rescission applies only to Refinancing, Home Equity loans, or 2nd Mortgages of your primary residence. It would not apply to lot loans because lot loans are considered a secondary transaction (not your primary residence). Also, Saturday would count as a rescission day. Sunday, or holidays do not count.
