During a legislated or approved leave of absence from work, employment is considered continuous. Therefore, an employee is still considered employed, though not earning wages. The leave does not affect employees' right to take vacation time; it only affects the amount of vacation wages earned. See the Vacations and Vacation Pay page for details on earning and paying vacation. Maternity leave is an unpaid leave so you would be entitled to vacation pay service Canada for more details.

yes or you could go to prison
Probably not. You may be able to use supplemental health insurance to create maternity leave income. If you work as a 1099 employee, you can get these benefits through a payroll deduction.
In the USA there are no mandatory minimum vacation time / maternity leave laws. So unless your employer voluntarily gives maternity leave (fairly uncommon) or you have vacation days to take, you don't get any time off. In other countries, leave like this will vary. Some countries, like France, require 30 days of vacation for the country's employees. And it offers 16 weeks, up to 26 weeks starting with the 3rd child, of maternity leave. The USA is one of if not the only 1st world nation not to require vacation / leave of almost any type.
