Can your ex get your kids just because he does not want to pay child support?

First, it is an Urban Myth that fathers go for custody to avoid paying child support. First, who would support the children while in his custody? Less then 15% of mothers are ordered to pay, and depending on circumstances, the custodial father is often still ordered to pay child support.

What right does a non custodial parent lose when they are incarcerated and pay no support?

Non custodial parents do not lose any rights when they are incarcerated and pay no support. Since they are incarcerated they usually cannot see their children because they are locked up but they did not lose the right to have visitation once they are released.

Can a custodial parent in North Carolina deny visitation with the noncustodial parent because the noncustodial parent moved out of state for work?

Only the court has the power to deny visitation rights.

What if the custodial parent does not allow the child to see the non-custodial parent even though the court said she can - does the non-custodial parents still have to pay support?

Child support and visitation rights are two entirely different issues. The terms of visitation should have been determined before divorce proceedings and finalized when the divorce decree was awarded. The court generally prefers the parents reach an amicable agreement for reasonable visitation by the non-custodial parent. If specified days/times have been ordered by the court the custodial parent must allow visitation or risk being in contempt of a court order.

Can a custodial parent stop the non-custodial parents visitation if they are behind on child support?

No, they are separate issues. If the custodial parent stops visitations they would be in violation of a court order. The custodial parent must address the child support arrears as a separate matter by filing a contempt order with the court.

Can a child that's 14 years old decide not to see his noncustodial parent because he is scared of him?

Do you still have to pay child support if your child is not attending school or is not being homeschooled in the state of Tennessee?

You continue to pay support until otherwise ordered by the court. If the parent moved out of state without court permission or in violation of a custody order interfering with the non-custodial parent's visitation rights, the non-custodial parent may file an action against the custodial parent for the same, or file for a modification in visitation, forcing the custodial parent to return the child for visitation as outlined in the original order.

Can a parent be in contempt of court for not allowing a non custodial parent visitation because she wont give her new address?

Yes. If the non custodial parent is denied visitation as outlined in the court order than the custodial parent is in contempt. Perhaps you should also establish a neutral exchange site and request the each parent notify the other parent within 48hrs any change in address or phone number. The custodial parent should know where the child will be when she is with the non-custodial parent. If something should happen to the non-custodial parent the custodial parent should know where to get the child. Wanting to keep that type of information secret shows a problem of non-cooperation and a parent who is not thinking of the best interests of the child.

Notice to the custodial parent is an important thing to most of them. It is advised that the visiting, or non-custodial parent, observe the formalities of the visitation requirements, especially in early days of the divorce relationship.Fights break out easily enough in these matters without fanning the flames. Considerate treatment of each other goes a long way towards dosing the flames, at least to a smoldering condition.1. Sign the letter.2. Keep a folder with letters of this kind in them, especially if you are the person paying child support, alimony, and the like (generally the non-custodial parent).3. Courts have made it clear, on a repetitive basis, that payment or nonpayment of child support and various other financial matters do not impact the rights to visit the minor children involved.4. This means the non-custodial parent may not withhold money payments if their visitation rights are violated and custodial parents may not withhold visitation rights if money is not paid as due by court order or agreement, certified by the court.5. Visitation is supposed to be about the children. Try to keep it that way. Good luck!

Do i have to tell the non-custodial parent that i am moving out of state with our child if he isn't paying child support?

In Most states child support is separate from custody. Even if the non custodial parent is not paying child support he / she can request to visitation. because the parent is in arears does not hinder him / her the right to visit the child. both visitation and support are doen separately. Uunless there was a divorce that stipulates the arangement.

What if custodial parent cannot afford to bring child to visitation every week?

Immediately notify whatever court issued the visitation ruling. Perhaps it will be modified because of your situation. Be careful! If youre not complying with the order(WHATEVER the reason) you could be held in contempt of court).

What to do when custodial parent keeps child from visitation?

There is nothing you can do about it because child support and visitation are two separate things. Even though a person does not pay their child support, you can still get into trouble if you do not allow them to have their visits with the child.
