In reference to real property that has been abandoned the town must initiate a court action to take possession of the property for non-payment of property taxes. Once that procedure has been completed the town is the new owner and can sell the property at an auction. If you have a particular property in mind you can visit the tax assessor's office and inquire about that property.

Salvage rights must be purchased from the owner of the property. In the case of abandoned real property, the city or town must take title to the property through a tax taking procedure. Citizens can then purchase the property from the town. You should inquire at the tax assessor's office where the property is located.

What factors must be considered in the legal title searches of a person's house commercial property and abandoned property?

"Abandoned property" must be taken by the town by a tax title process in order for the town to have the authority to sell it to a new owner. If you have a particular property in mind then you need to visit the local tax assessor's office to determine its status. Someone may be paying the taxes or you may find that the taxes have become delinguent. In that case you can ask if and when it will be offered for sale by the town. See the related link for an overview on the factors that are reviewed by a title examiner when examining the title to real property.

How does one acquire an abandoned property if the owner can't be found?

Check with the tax assessor's office to see if the property has been taken by the town for non-payment of property taxes. Generally, the only way to buy "abandoned property" is to purchase it from the town because towns have the authority to take title to property when the taxes are in default. In the United States, title to real property must be transferred legally- you can't just claim it. Inquire about purchasing it from the town. What is the Statutes of limitations on abandonment of personal property?

Generally, when real property is "abandoned" there are other entities that can acquire title legally. If there is a mortgage in default, the bank can foreclose and take possession of the property. If there is no mortgage and the owner has abandoned the property the town can take possession of the property for non-payment of property taxes. Title to real estate must be transferred legally. If you are thinking of acquiring property by adverse possession, in Mississippi, the duration of such possession is ten (10) years. Mississippi Code §15-1-7, 13.
