I assume you don't mean You aren't jailbroken but rather your iPhone :-) In a nuts shell jailbroking process implies removing iOS protection from installing apps from any source except the Apple's iTunes App Store. Technically there are several ways of doing it but it's either you run any of these procedures on your iPhone or feed your iPhone with apps from the App Store. And no 3d option whatsoever.

There should be no reason to get free apps illegally. The App Store does not allow you to get an app illegally.
The iPod Touch should not delete things when you update it. All content should remain on the iPod (unless you have a jailbroken iPod, in which case it will remove all non-App Store apps and other jailbroken features).
