Can a mortgage company sue for the entire amount of a second mortgage after foreclosure even though they received money to cover the first and some of the second after the sale of the property?

First, it is unclear how you know the mortgage company received money toward the second mortgage from the foreclosure of the first mortgage. The lender can sue for the second mortgage. You should consult with an attorney who can seek documentation from the lender to support the amount they are suing you for.First, it is unclear how you know the mortgage company received money toward the second mortgage from the foreclosure of the first mortgage. Should you sue a title company for not paying your mortgage balance at closing which caused your house to go into foreclosure?

Notice should have been given to the homeowner by the mortgageholder letting them know that the balance on the mortgage had not been paid. At that point the title company could have been contacted and the matter should have been cleared up before the mortgage holder could finalize foreclosure proceedings. Therefore, I do not believe that the title company could have caused a mortgage foreclosure.

Will a loan modification application stall foreclosure proceedings?

I know of people who applied for the modification but all the while the mortgage company proceeded with the foreclosure. So, yes they still will foreclosure apparently. Its like one hand doesn't know what the other is doing. the individuals that I know had to file chapter 13 bankruptcy to stop the foreclosure sale from happening

Is there any way to get a mortgage if you went through foreclosure and have a FICO score below 500 but have 50000 capital to invest?

If you just went through a foreclosure I know of no one that will give you a mortgage for a number of years. I tell people to sell the home before it goes to auction.

If your home is foreclosed on are you still liable for the mortgage?

To answer this we would need to know where the home is. States such as California only allow lenders one action, which is usually the foreclosure. After that they can not be persued. A second mortgage however, may persue if they did not do the foreclosure. Other states allow for deficiency balances to be persued through collection actions and the courts.

Do you have to be notified prior to getting a call saying your in foreclosure?

How can you find out what their california mortgage rate is?

If your mortgage is through a bank, call them. If it's through a mortgage company then they could tell you anything you needed to know. Just give them a call.

I rent and want to know where to find out if the mortgage is late?

Whether the mortgage is late is none of the renter's business: it's a matter between the landlord and his mortgage lender. The mortgage lender will not discuss business with any other than its client. As long as the landlord has control of the property-- regardless of foreclosure status-- the rent will alway be collected by him and he can evict you if you don't pay.

What can I do to stop home foreclosure?

I think the best way to avoid foreclosure is to prevent the filing of a Notice of Default. Lenders do not want to foreclose but will file a Notice of Default to protect their interests, if necessary. If you know you are unlikely to meet your mortgage obligation, the first thing you should do is call your lender.

How do you know if you had mortgage insurance?

This depends on what you mean by mortgage insurance. If you are talking about products like PMI (Premium Mortgage Insurance) look on your escrow billing and it will be listed. If you are talking about a life insurance policy that would be either through credit life with your mortgage company or separately through an insurance company.
