  • Albertans would be shocked if they knew that the Alberta Human Rights and Citizenship Commission did not protect the elderly at all even when complaints are filed with them. Often doctors and nurses know about the abuse, but they go unreported. The best thing to do is to use technology such as a camcorder, etc., hidden well either in the private home of the caregiver for the elderly person or hidden in the room at the nursing home. Many Canadians have used this method to catch especially nurses; aides and personal caregivers often brutally harming the elderly person in their care. Once an individual has proof they can then take it to the lawyer. The police can do very little in this situation; but the proof and a good lawyer will be sure the elderly are protected.

What do you do when a child is being charged with elder abuse when there was no elder abuse?

== == No elder, no crime. Read the statute your child is being charged with. If the prosecution cannot prove any part of it beyond a reasonable doubt, they have no case. You should look up any words in the statute that you are unfamiliar with to see what they mean in the eyes of the court. Your child should have a attorney; if you cannot afford one, one will be appointed for your child at no cost.=)

How does a person defend themselves from false allegations of elder abuse in Canada?

When there are allegations against an individual re elder abuse in Canada that individual would be wise to find a lawyer to defend them. Whoever is accusing the individual of elder abuse needs to prove that fact and also have witnesses. Some people mean well and feel in some circumstances that the caregiver is being abusive to an elder. Example: If a caregiver is looking after a parent who has Alzheimer's they can at times become violent or wander away from home and the caregiver may have to put restraints on them to keep them from lashing out; hurting themselves or wandering away anytime during the day or night. Another relative or friend that may witness this may consider this elder abuse.
