In the United States, the War Powers Act, allows the US President to carry out military actions that for all practical purposes are wars. Under the US Constitution, the US Senate has the authority to declare war. However, the US Supreme Court has ruled that the War Powers Act is constitutional. The idea is that the President must act quickly with military force to protect the nation. This normally is allowed by Congress. The only restraint is that military actions must be funded. It is at that juncture that Congress can place pressure on a president to fully explain why military action was & is needed. So far, the Congress has gone along with the president. The idea, according to some political scientists is that by waging a war in this fashion, somehow softens the "blow" of an outright declaration of war. And allows such a war to then be slowed down to whatever degree is necessary without declaring either a success or a failure. All this is controversial, however, it is quite constitutional.
