What you have is a contract between yourself and the bank. If you violate the terms of the contract by failing to make payments as required, then the bank may be able to pursue a civil case against you...depending on the laws of your particular state...and take you to court to get their money. But if you had money, you'd already have paid them, so they don't typically bother with that option.
Usually, they'll just sell your debt to a 3rd party collector, who may very well use all sorts of threats and intimidation to get you to pay, even though they have even less legal standing than the bank did.
