The elements of such an award will depend on the laws of the state and the federal Americans with Disabilities Act. (ADA). An award of damages in this kind of suit can consist of legal and equitable relief. The legal relief would consist of compensatory and possibly punitive damages as well as an award of plaintiff's counsel fees. Compensatory damages would include monetary losses incurred as a result of the termination, such as back pay, expected increases in pay, lost bonuses, costs of finding a new job, etc. Also sometimes, wrongful termination laws provide for automatic doubling or tripling the compensatory damages. Punitive damages could be like a fine payable to the plaintiff, not the state, against the company because the termination is an intentional action that is illegal. If the compensatory damages are increased, punitive damages might not be awarded, since the doubling or tripling of compensatory damages has the effect of punitive damages. Plaintiff may be awarded money to pay the lawyer. (that one is my personal favorite part of the damages). This is important because many jurisdictions do not make the loser of a lawsuit pay the winner's legal fees. Equitable relief would be something like restoration to position, increase in rank or restoration of sick days, personal days, vacation days that would have been earned if plaintiff had been working all that time.
There are no set awards of damages in civil cases. The jury must consider the relevant facts, and estimate the appropriate amount to "make the plaintiff whole" or put the plaintiff in the place where he/she would have been if not wronged.
If a person was wrongfully terminated from their job for health reasons, they may be able to sue or draw unemployment. The person will need to speak with and possibly hire an attorney.
No job can be terminated because of Religion
No, not unless the termination is based on your work performance prior to the disability. You may want to have a good workers compensation attorney talk with you. You could have a wrong-full termination and/or discrimination of disability's claim.
Slander
A person on disability should not earn anything besides getting their monthly check. They are on disability because they are not able to work
no
I don't think that just because a person's kidney has failed, he will be terminated from his job. Because it is not a kind of communicable disease that will pass from one employ to another. A person's efficiency in job is not counted from his disease, he have. But the quality and quantity of work he does in his office. So, if someone is fit to do the job, he/she will not be terminated from his job.
Yes, it is perfectly normal. A handicap person shouldn't be categorised because of their physical state because they are normal people. They have the right to be in a relationship as much as anyone else, and your feelings for them should not change because of their disability it shouldn't matter to you, see the person not the disability! Simarlily your age should not matter either as with someone's disability.
Its possible because both of y'all is on work premises.
impact of a congenital disability have on a person
Unless the person is declared incompetent, disability does not interfere with the person's ability to contract.
It depends what kind of disability
