AnswerYou may have child support payments enforced by the court if you file with the courts that you are legally separated. The child support can be deducted just like child support ordered by a divorce decree. During a divorce (from the time papers are filed until they are finalized), the agreements or orders from a judge are called temorary orders. This will include child support, visitation, etc. If you are not filing for divorce and your spouse is amicable, you may make these arrangements yourself and do not need to file them with the court. If your spouse is not amicable and you do not want to incur attorneys fees, you may come up with certain agreements and go to a court mediator (usually a judge or certain appointed attornies that can rule without a trial) to settle those things you can't agree on. Call or visit your local county court to get more information about mediation or filing papers regarding your legal separation, visitation and child support agreements if you can agree to them. Usually, the more unfriendly the relationship, the more court enforcement is needed. Don't let him use money to try to hurt your or force you to go back to him. You have a right to child support if you are separated even if you haven't filed for divorce. He has rights also.
